Terms and conditions
1. About these terms
These terms are an agreement between you and LarentaPay (“we”, “us”) for the use of the LarentaPay website, web application, mobile app and API (together, “the service”). “You” means the landlord, company or letting agency that opens a workspace, and anyone you invite into it.
By creating an account, starting a trial or using the service, you accept these terms. If you accept on behalf of a company, you confirm you are authorised to do so.
2. Your account and signing in
- You can sign up with an email address and password, or with a Google account. Tenants you invite sign in with the email and password from their invitation.
- Give accurate details and keep them up to date, including the mobile number used for subscription payments and notices.
- Keep your login secure. Each login is for one person. Don’t share passwords. Tell us straight away if you think someone has accessed your account without permission.
- You are responsible for what people you invite (agents, accountants, caretakers) do in your workspace, and for removing their access when they leave.
3. Free trial and subscriptions
- New workspaces get a 30-day free trial on the plan chosen at sign-up. No payment is needed to start.
- Plans are billed monthly or yearly in advance. Each plan has limits on units, properties and team members, and includes a number of SMS each month.
- We raise a renewal invoice 3 days before your trial or paid period ends and notify you by SMS.
- If the invoice is not paid by the end of the period, you have 7 days’ grace with full access. After that, your workspace becomes read-only: you can still see and export your records, and incoming rent payments are still recorded, but you can’t add or change anything until you pay.
- Upgrades take effect immediately, so you can use the higher limits straight away. The higher price applies from your next renewal.
- Downgrades take effect at the end of your current period, and only if your usage fits within the smaller plan’s limits.
- We may change plan prices. We’ll tell you at least 30 days before a change affects your next renewal.
4. Paying for LarentaPay
- Subscriptions and SMS bundles are paid by M-Pesa to our Paybill, from inside the app. Prices are in Kenya shillings and include any applicable taxes unless stated otherwise.
- Payments are non-refundable, except where the law requires otherwise or where we have charged you in error.
- If a payment is reversed or found to be fraudulent, we may suspend the workspace until it is settled.
5. Rent collection and M-Pesa
- Rent paid by your tenants goes directly into your own M-Pesa Paybill, Till or bank account. LarentaPay never receives or holds your tenants’ money.
- You are responsible for your agreement with Safaricom or your bank, and for keeping your M-Pesa API credentials valid. We store those credentials encrypted and only use them to receive payment notifications and send payment prompts.
- We match payments to units automatically using the account number the tenant enters and their phone number. Check payments that can’t be matched, and reconcile against your statements regularly. You are responsible for the final records you rely on.
6. SMS messages
- New bills, rent reminders and payment receipts are sent from our SMS provider (Africa’s Talking) on your behalf. You choose which are sent in Settings.
- SMS are not included in plans. You request an SMS bundle and pay by M-Pesa; we approve the request and the SMS are added to your workspace. Approved SMS don’t expire while your workspace is active and are not transferable. If we can’t approve a request, we refund the payment.
- Use SMS only for messages about the tenancy. Marketing messages to tenants need their opt-in consent, which you must record.
- Delivery depends on mobile networks. We refund credits for messages the provider rejects, but we can’t guarantee every message is delivered.
7. Your data and your tenants’ data
You own the data you put into LarentaPay. For your tenants’ and staff’s personal data, you are the data controller and we are your data processor under the Kenya Data Protection Act, 2019 (and the EU GDPR where it applies). By accepting these terms you also accept our data processing agreement, which forms part of them. In short, we:
- process personal data only to provide the service and on your instructions;
- encrypt sensitive details such as ID numbers, KRA PINs and bank details, and keep a log of who views and exports personal records;
- use a small number of sub-processors to run the service: hosting, Safaricom (M-Pesa), Africa’s Talking (SMS) and Google (sign-in). We tell you before adding new ones;
- help you respond to tenants’ requests to see, correct or delete their data, using the tools in the app;
- tell you without undue delay, and within 72 hours where possible, if we become aware of a breach affecting your data;
- delete or anonymise personal data when it is no longer needed, while keeping financial records for as long as tax law requires.
You are responsible for having a lawful basis for the tenant data you add, giving tenants a privacy notice, and registering with the Office of the Data Protection Commissioner where the law requires it. See our privacy notice for how we handle your own personal data.
8. Acceptable use
Don’t use the service to break the law, harass tenants, send unsolicited marketing, upload malicious code, try to access other customers’ data, or overload or reverse-engineer the service. We may suspend accounts that do, and will tell you why unless the law prevents us.
9. Reports, tax and accounting
Reports, including the rental income tax estimate, are produced from the records you enter and the rates configured in the service. They are not tax, legal or financial advice. Check figures and current KRA rules, or ask a qualified accountant, before filing returns or making decisions.
10. Availability and support
We aim to keep the service available at all times, but there may be interruptions for maintenance, updates or reasons outside our control, such as outages at Safaricom, Africa’s Talking or our hosting provider. We give notice of planned maintenance where we can. Support is available by phone, WhatsApp and email during Mon–Fri 8am–6pm, Sat 9am–1pm.
11. Ending your subscription
- You can stop paying at any time. Your workspace becomes read-only after the grace period, and you can export your data.
- You can ask us to close your workspace. We delete or anonymise personal data within 90 days, except records we must keep by law.
- We may close workspaces that have been read-only for more than 12 months, after giving at least 30 days’ notice by email and SMS.
12. Liability
The service is provided with reasonable skill and care. To the extent the law allows, we are not liable for indirect losses such as lost profits or lost rent, and our total liability to you in any 12 months is limited to the amount you paid us in that period. Nothing in these terms limits liability that cannot be limited under the laws of Kenya, including under the Consumer Protection Act, 2012.
13. Changes to these terms
We may update these terms. If a change materially affects you, we’ll notify you by email or in the app at least 30 days before it takes effect. Continuing to use the service after that means you accept the updated terms.
14. Governing law and disputes
These terms are governed by the laws of Kenya. If there’s a dispute, we’ll first try to resolve it by talking to you. If that fails, either of us may refer it to mediation in Nairobi before going to court. The courts of Kenya have jurisdiction.
